1Agreement & Acceptance

These Terms & Conditions constitute a legally binding agreement between you ("User", "Creator", "Customer", or "you") and FanSome("we", "our", or "us"). By registering for an account, browsing our website, purchasing digital goods, or publishing digital products, you accept and agree to comply with all clauses outlined herein, as well as our Privacy Policy, Content Guidelines, and CSAE Safety Policy.

2Account Eligibility & Registration

FanSome is a digital commerce and creator storefront platform specializing in the sale of digital goods, downloadable products, and digital services. You must meet the following eligibility requirements:

• You must be at least 18 years of age (or the legal age of majority in your jurisdiction) to register an account, purchase digital goods, or set up a creator storefront.
• You must not have been previously suspended or removed from our services.
• All information provided during registration (including identity details for KYC checks) must be truthful, accurate, and current.

3Digital Storefronts & Creator Sales

Creators use FanSome to host digital storefronts and sell digital goods such as downloadable ebooks, guides, presets, design templates, software assets, audio packs, and 1-on-1 video call consultations. Creators retain ownership of their original intellectual property.

• KYC Verification: Creators must successfully pass our identity verification process, which includes linking a valid bank account and providing government-issued identification before listing paid digital products or receiving payouts.
• Platform Fees & Revenue Share: FanSome charges a standard platform fee of 20% on digital product sales and service bookings unless a custom rate has been agreed upon in writing. This fee covers file hosting, secure cloud delivery, payment gateway processing, and platform operations.
• Creator Payouts: Earnings from digital product sales are calculated and disbursed to verified bank accounts in accordance with platform payout schedules, subject to standard holding periods for security and fraud prevention.

4One-Time Purchases & Payment Terms

All purchases made on FanSome are one-off, single transactions for digital goods or consultation services.

• No Recurring Subscriptions: The platform operates strictly on a one-time purchase model. There are no recurring monthly subscriptions or automatic renewals.
• Immediate Digital Delivery: Upon successful payment processing, access to the purchased digital product or download link is granted immediately.
• Payment Authorization: By initiating a purchase, you authorize our integrated payment processors (such as Razorpay or CCAvenue) to charge your selected credit/debit card, UPI account, or net banking option for the specified one-time amount.
• Disputed Transactions: Initiating fraudulent chargebacks or payment disputes constitutes a breach of these terms. Accounts associated with fraudulent billing practices will be immediately terminated, and access to purchased digital files will be revoked.

5License & Intellectual Property Rights

When you purchase a digital product on FanSome, you are granted a non-exclusive, non-transferable, personal license to download and use the product in accordance with the specific product license terms specified by the creator.

• You may not resell, redistribute, re-license, share, or publicly broadcast purchased digital files unless explicitly authorized under a commercial license.
• Creators warrant that all digital products listed on their storefront are original creations or properly licensed works that do not infringe upon third-party copyrights or trademarks.

6Prohibited Content & Acceptable Use

All creators and customers must adhere to legal and brand-safe community standards. The following are strictly prohibited:

• Pornography, explicit sexual content, or escort services.
• Child Exploitation and Abuse Material (CSAE).
• Pirated software, unauthorized copyright rips, or counterfeit digital products.
• Malware, viruses, spyware, or malicious code embedded within digital downloads.
• Hate speech, harassment, violence, or illegal activities.

7Limitation of Liability & Disclaimers

FanSome provides the digital commerce infrastructure for independent creators. We do not guarantee specific outcomes, fitness for a particular purpose, or error-free availability of third-party digital files, though we strive for maximum uptime and security. In no event shall FanSome be liable for indirect, consequential, or punitive damages arising from the use of digital goods purchased on the platform.

8Governing Law & Jurisdiction

These Terms & Conditions shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. Any dispute arising under or in connection with these terms shall be subject to the exclusive jurisdiction of the courts located in Bangalore, Karnataka, India.
